The official defence documents filed by the HSE in Ms Phelan's case show that the state was also denying it had any duty of care towards her husband, who also took part in the action against the HSE and the U.S. lab which carried out the misread test.

She told the court that at least three other women who got all-clear smear tests have died.

"I would like this evening to announce that I have taken a decision to stand aside from my role as Clinical Director of CervicalCheck with immediate effect". I have chose to step aside to allow the Programme to continue it's important work'.

The 206 women whose smear tests were misread should have been referred on for further investigation, including an invasive diagnostic procedure or repeat smear, which could have picked up their cancer and led to earlier treatment.

The HSE said it wished to acknowledge Professor Flannelly and to formally thank her for "the enormous dedication, contribution and expert knowledge" that she brought to the CervicalCheck Programme over the past 12 years.

"In the interests of meeting the needs of the women who rely on the CervicalCheck Programme, the HSE acknowledges that the programme's leadership is completely focused on working as part of the HSE's Serious Incident Management Team to address the current concerns", it added.

According to the HSE, nearly 1,500 cases of cervical cancer have been notified to the cervical screening programme, CervicalCheck, since it began a decade ago.

Minister for Health Simon Harris on Saturday told CervicalCheck to facilitate further smear tests for women whose Global Positioning System feel it is necessary.

Minister Harris did say he has every confidence in the screening process, which he said saved lives.

The lid was blown on the CervicalCheck cancer earlier this month when Limerick mum-of-two Vicky Phelan, 43, took a High Court case against the HSE and the Texas-based lab which distributed her smear test results in 2011.

Ms Phelan revealed on the Ray D'Arcy Show on RTÉ 1 last night that Minster Harris rang her to personally apologise for what happened to her.

This week Mrs Phelan was awarded €2.5 million from the high Court, which she said would go towards making her final days more comfortable for her and her two young children.
