VirnetX +28.1% on Apple patent victory

VirnetX +28.1% on Apple patent victoryā€¯

In February 2016, a second trial resulted in a $625 million verdict against Apple.

Lodged back in 2012, VirnetX's original complaint accused various Apple products (including the iPhone, iPad, iPod touch and some Mac computers) of infringing on the non-practicing entity's intellectual property covering various "secure data communications" platforms, such as its FaceTime, iMessage and VPN on Demand.

It's a huge win for VirnetX, which exists mainly to attempt to hoard patents it has no intention of ever using, and then find companies to which it can license those technologies. While there will nearly certainly be jubilation at the ruling, Apple has a history of appealing.

VirnetX is based in Zephyr Cove, Nevada, and it filed its suit in patent troll-friendly East Texas, a district where patent holders have had a higher chance of success in intellectual property cases until the Supreme Court cracked down on the practice past year.

The evidence was clear.

In a statement to Bloomberg, VirnetX CEO Kendall Larsen called the damages amount "fair".

Reports claim that the legal battle between Apple includes many legal suits and a myriad number of appeals.

The case is now being reviewed by the Court of Appeals for the Federal Circuit in Washington, which will determine whether or not VirnetX's patents are actually invalid. There have been multiple trials, most recently one involving earlier versions of the Apple devices.

This could be a short-lived victory for VirnetX, however. That's because PTAB believes VirnetX's patents are invalid even for cases now in progress.
