Lawsuit accuses 3 former MSU basketball players of rape

Lawsuit accuses 3 former MSU basketball players of rape”

None of the players were named in the suit.

Accusing MSU of a lack of transparency in its handling of sexual assault complaints, Doe claims it flaunts normal policies and procedures in sexual assault cases involving high-profile male athletes and allows coaches to investigate complaints behind closed doors.

Almost a year later the woman resumed classes at MSU, but to date her attorney claims that the university has done nothing.

The woman said she met the team at a bar and one offered to buy her a drink. After accepting, the plaintiff was introduced to the other players and invited to their apartment for a party. There, her roommate told her she did not know about a party.

"Plaintiff was feeling discombobulated". "She tried to send a phone text, but she could not control her thumbs to formulate a text". When they got to the room, the woman said she was thrown face-down on the bed, held in place and raped from behind, according to the lawsuit. The suit also explicitly states that "At no time did Plaintiff indicate she had a romantic interest in any of the team members that approached her".

Doe claims she was not romantically interested in the player or his teammates. She agreed and asked for some water because she was incredibly thirsty.

As soon as JD2 was done, JD1 and JD3 came in and held the alleged victim down, taking turns raping her, according to the lawsuit. "At no time did she consent to the sexual activity", the lawsuit states.

Before she left the bar she was already having a hard time holding on to her glass, the lawsuit stated, even though "she had not had a lot to drink".

According to the lawsuit, the university never told the woman that she had a right to a "no-contact" order that would have prevented the players from entering the campus housing where she lived.

After the woman told counsellingcentre staff that basketball players were involved, she said the staff made it clear that if she reported it to police "she faced an uphill battle that would create anxiety and unwanted media attention", according to the lawsuit.

The group "Reclaim MSU", an alliance of students and faculty calling for meaningful reform at the school, said the process remains "convoluted" for students who want to report instances of sexual assault and understand their rights.

"Plaintiff was expressly told by [counseling center] staff that 'if you pursue this, you are going to be swimming with some really big fish, ' " the lawsuit alleges.

This caused the alleged victim to be so frightened, she decided not to report the rapes.

Ultimately, the victim alleges that she became "traumatized" by the attack and was later hospitalized at the Sparrow Hospital outpatient psychiatric day program for intensive psychiatric treatment. She also lost months of schooling and eventually changed her major.

Michigan State went 27-12 that season, finishing third in the Big Ten and reaching the Final Four as a 7-seed in the East Region before getting knocked out of the tournament by eventual-national champion Duke. The university provided no guidance beyond that. She later withdrew from the university for the fall 2015 semester and resumed classes in 2016 with a different major.

"MSU has fostered a culture in which female victims are discouraged from reporting sexual assaults when those assaults are perpetrated by male athletes, thus protecting the university, the male athletics programs, and the male athletes at the expense of the female victims", the lawsuit stated.

The lawsuit is the latest in a series of sexual assault allegations at MSU.
