SC Justice Clarence Thomas Impeachment Debate Gains Momentum”

The Supreme Court on Tuesday refused to hear a challenge to a California law that requires there be a 10-day waiting period after all gun sales, even if the person is already a registered gun owner. California also argues the law has a "cool down" effect, as it may deter prospective gun owners from inflicting harm on themselves or others if they attempt to buy a firearm in an emotionally compromised state.

Political pundits have savaged a NY magazine article re-litigating the case for Supreme Court associate justice Clarence Thomas' impeachment, which purportedly cites new evidence Thomas lied under oath about Anita Hill during his confirmation hearing.

Although the Supreme Court held, for the first time in 2008, that the Second Amendment protects an individual right to own firearms, the Court's decision in District of Columbia v. Heller still leaves lawmakers with considerable leeway to regulate these firearms.

Additional reporting from Newsy affiliate CNN. "The Ninth Circuit would not have done this for any other constitutional right", Thomas maintained. Among other things, Justice Antonin Scalia wrote for the Court in Heller, "nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms".

A District Court judge ruled in their favor, noting that people who already met the requirements for a concealed carry permit were not likely to "engage in impulsive acts of violence". He took his colleagues to task, saying, "Our continued refusal to hear Second Amendment cases only enables this kind of defiance". They said the state's claimed need for a "cooling off period" makes no sense if the buyer already has a gun.

"I still believe that the Second Amendment can not be 'singled out for special-and specially unfavorable-treatment, '" Thomas wrote.

Anita Hill takes an oath during a 1991 Senate hearing after accusing U.S. Supreme Court nominee Clarence Thomas of sexual harassment. While those laws reflected the wisdom of "thousands of years of human history in every society known to have populated the planet", they faced a much tougher time in the Ninth Circuit than California's new and unusual waiting period for firearms. In reviewing whether a law appropriately limits the Second Amendment right to bear arms, Thomas argues, the court must evaluate evidence that such a measure is necessary to meet a governmental interest.

Abramson called Thomas' position in the court as having been "devastating for women's rights, mentioning his votes on cases involving equal-pay protections and employers' religious objections to supplying birth control".
