USA driver faces charges after child found dead in van”

The Orlando daycare facility where a 3-year-old died in a sweltering van had recently been written up for issues with monitoring childrens' departures and arrivals.

"This is an absolute tragedy that could have been prevented", said Orlando Chief of Police John Mina at a press conference Tuesday morning.

At about 9 a.m. Monday, the driver had picked up Myles and other kids at the center and drove them to another Little Miracles location.

More than 100 people gathered to remember a 3-year-old Florida boy who was found dead in a van parked outside his day care center.

State records dating to 2015 show that Little Miracles Academy has been cited for lax practices regarding personnel records, supervision and transportation, according to CNN.

The van is used by the day care center to transport children from one day care location to another, as well as pick them up and drop them off at their homes.

"I was on the phone with her and she started to scream, 'He's in the van, dead!'" Livingston recalled, saying the "very happy little boy" who would've turned 4 later this month died simply due to being abandoned. Temperatures in Orlando on Monday hovered in the low 90s, with a heat index eclipsing triple digits. "If you have six kids get in the van, you make sure six kids get out of the van".

Mina said that when Myles did not return home on Monday evening, his grandmother called both the police and the daycare. Other violations included not having a caretakers in sight when the children were napping and not keeping attendance records during a fire drill, the records say. The employee brought the van back to a parking lot at the original location around 9 a.m. and left it there for the rest of the day. According to the department, all child care personnel are required by law to report any "suspicions of child abuse, neglect or abandonment".

The DCF did not respond to inquiries about whether Little Miracles Academy faced any repercussions for failing to meet these standards. "It would've been different if she had come out", Esters said.
