New America's Got Talent host Tyra Banks has hit an early bump in the road, with a lawsuit filed against the show on Tuesday.

In the lawsuit, filed in Los Angeles Superior Court on Monday, the woman alleged that she and her husband auditioned for the hit show in NY in January, performing a song about motherhood, which "held a certain long-term emotional importance" to her young daughter, named "Mary" in the suit.

Jane says that she was "humiliated" when the audience and judges began to criticize the song - not an uncommon occurrence on reality competitions - but things turned very sour when Banks continued to mock the song to Mary.

Banks "physically manipulated and verbally abused Mary", shaking her shoulder and pulling her hair, the suit claims.

The suit aims for a jury trial and seems to have the ultimate goal of keeping the footage of their performance off the air. While she reportedly needed a special push from her mother as a newcomer to the show, Banks is excited to get started. Producers then asked the young girl, referred to as Mary Doe in the suit, about the song and she told them she asked her parents to perform it, according to the complaint filed Monday in Los Angeles County Superior Court.

Jane says that because of the "AGT" experience, Mary has suffered long-term emotional distress, depression and trauma. They refused to completely edit Jane and her husband's performance, maintaining they will "exploit all footages" despite not airing it in its entirety. While the judges weren't feeling the song, the parents say they did not have a problem with their crticism as much as they did with Banks's interaction with their daughter back stage.

It's pretty heavy stuff, and the fact that Tyra Banks is still new on America's Got Talent - The Inquisitr reports she was announced as a host in March - will not help her in keeping the gig. They agreed to cut out Mary, but they said that they will still air John and Jane's original song.

The couple seek damages for infliction of emotional distress.

Marathon, NBC and representatives for Banks did not immediately respond to a request for comment.
