Judge blocks enforcement of Obama transgender-bathroom policy”

"Because the Obama administration had tried to implement a policy that would threaten Title-9 funding of public schools if they didn't allow boys to go into girls showers, bathrooms and locker rooms - and the federal judge explained that because the letter was supposed to apply to every public school - then the injunction has to apply nationwide, as well", Hudgens explains.

The student, identified only as Student A, was given access to the girl's locker room after she filed a complaint with federal education officials, who found that the district was violating Title IX - federal laws protecting students against sex-based discrimination.

A federal magistrate has ruled against a group of parents seeking an injunction denying a transgender student the ability to use a suburban Chicago high school's restrooms and locker rooms. "In the public school context, these directives would also allow boys to demand they sleep with girls during overnight off-campus trips".

After the Obama administration in May advised school districts to allow students to access bathrooms based on their gender identity, Texas and 11 other states sued, claiming that allowing transgender students to use the bathroom of their choice would turn schools "into laboratories for a massive social movement".

Gilbert's recommendation shows that there's no harm in students sharing restrooms and locker rooms with students they perceive as different, according to John Knight of the American Civil Liberties Union of IL, which is representing the transgender student. The guidance follows similar policies in states and school districts across the country, including many that have been treating transgender students with dignity and respect for more than a decade.

The State of Texas is defending a local school district whose school policies are in conflict with the Obama Administration directive, the Harrold Independent School District.

"Young students should be not be forced into an intimate setting like a locker room with someone of the opposite sex", the ADF senior counsel Gary McCaleb said in a statement on Tuesday.

If Alonso agrees with Gilbert's recommendation, the transgender student won't be forced to use facilities separate from fellow students.

"A transgender person's gender identity is an important factor to be considered in determining whether his or her needs, as well as those of cisgender people, can be accommodated in the course of allocating or regulating the use of restrooms and locker rooms", he continued. "We are pleased that Judge Gilbert rejected specious arguments about privacy and protected the interests of all the students".
