The guidance follows similar policies in states and school districts across the country, including many that have been treating transgender students with dignity and respect for more than a decade.

The State of Texas is defending a local school district whose school policies are in conflict with the Obama Administration directive, the Harrold Independent School District.

"Young students should be not be forced into an intimate setting like a locker room with someone of the opposite sex", the ADF senior counsel Gary McCaleb said in a statement on Tuesday.

If Alonso agrees with Gilbert's recommendation, the transgender student won't be forced to use facilities separate from fellow students.

"A transgender person's gender identity is an important factor to be considered in determining whether his or her needs, as well as those of cisgender people, can be accommodated in the course of allocating or regulating the use of restrooms and locker rooms", he continued.
